Intuitive eDiscovery
eDiscovery can be extremely complex for large data sets and requires a combination of a strong management process backed by technology. One of the biggest challenges in the identification and recovery of information lies in the nature of the data.
Electronic Discovery (or eDiscovery) is the field dedicated to the collection, storage and management of electronically Stored Information (ESI) for the purpose of identification and recovery of evidence in civil litigation.
Keyword Search
Keyword search techniques have been in use for a long time. These techniques are familiar, easy to use, efficient and accurate.
With the increase in the volume of data being searched, we have seen several identified problems with keyword searches applied in the eDiscovery context.
Over-inclusion and Under-inclusion:
Searching for relevant documents in large data sets using keywords can result in too much or too little results. This problem is called over (or under) inclusion is a symptom of the current state. Often in the form of unstructured data, traditional keyword search techniques can actually be detrimental to the goal of finding responsive documents.
Polysemy:
A single word can have multiple meanings depending on the context. The context can include industry-specific jargon, acronyms etc. that can give misleading results. For example, a tree means different things to a botanist and a software programmer.
Synonymy:
Finding synonyms is more than finding related words in a thesaurus or dictionary. Synonyms could be extended to the task of finding words that are not documents. This could include slang or code words used in a project or operation shared by a group of individuals.
To address these issues, eDiscovery has had to fall back upon the manual alternative with armies of legal experts in tow. This is expensive, cumbersome, management-intensive and often unreliable due to the vagaries of human nature.
